Current Italian health and safety regulations contained the Health and Safety Consolidated Act 2008 find their origin in the EU legislation implemented in the ninenties, as amended. The pillars of the legal framework are the prevention against risks arising out of or in connection with the activities of persons at work and joint liability for all the participants. This means that it is not just the duty of every employer to ensure the safety at work of all his employees as already stated under section 2087 c.c., but it is the duty of every employee while at work to take care for the safety of persons who may be affected by his acts or omissions and that of himself. The fundamental tools to fulfill the duties are based on knowledge transfer and information: the awareness of the specific risks safety arising out of or in connection with the activities of persons at work, possibly supported by non technical expertise, is therefore a precondition of every working organization.
