Having placed the legal protection of the environment within the context of contemporary “factual situations” and the current perspectives of the “ecological transition” and “resilience”, this essay sets out to trace the main stages of development that environmental protection has undergone to date within the Italian constitutional order, whilst also attempting to outline some possible scenarios for its future evolution. Taking as a unifying framework the relationship between public policies and subjective legal situations – and, consequently, the respective roles of the legislative, administrative and judicial branches – the Author organises the discussion into three parts: the first sets out to illustrate the most significant features of the Italian legal tradition regarding environmental protection up to the constitutional reform of 2022; the second focuses on the content and the most immediate and direct effects of the constitutional amendment, as well as on the meaning to be attributed to the concept of “ecological primacy”; finally, the third part is devoted to identifying some possible avenues for development which, looking to the future, could (or “should”) arise from the synergistic combination of the new provisions enshrined in the constitutional text with the context of the factual situations to which the prospect of an “ecological transition” refers.
Dopo aver inquadrato la tutela giuridica dell’ambiente nel contesto delle “situazioni di fatto” della contemporaneità e nelle attuali prospettive della “transizione ecologica” e della “resilienza”, il saggio si propone di ripercorrere le principali tracce evolutive del percorso che la tutela ecologica ha seguito fino a oggi nell’ordinamento costituzionale italiano, provando anche a prefigurare alcuni possibili scenari di evoluzione futura. Assumendo come chiave di lettura unitaria quella del rapporto tra politiche pubbliche e situazioni giuridiche soggettive e, dunque, dei compiti rispettivamente spettanti alle funzioni legislativa, amministrativa e giurisdizionale, l’Autore organizza l’esposizione in tre parti: la prima è rivolta a illustrare i tratti più significativi della tradizione giuridica italiana sulla tutela dell’ambiente fino alla riforma costituzionale del 2022; la seconda si concentra sui contenuti e sugli effetti più immediati e diretti dell’intervento di revisione della Costituzione, nonché sul significato da attribuire al concetto di “primazia ecologica”; la terza, infine, è dedicata alla individuazione di alcune possibili linee di sviluppo che, in prospettiva futura, potrebbero (ovvero “dovrebbero”) scaturire dalla sinergica combinazione delle nuove formule iscritte nel testo costituzionale con il contesto delle situazioni di fatto cui si richiama la prospettiva della “transizione ecologica”.
