Michel Villey e il significato "autentico" della responsabilità

The essay illustrates the theme of responsibility theorised by Michel Villey in two studies: the first, published in 1969, is devoted to criminal responsibility in the thought of St Thomas, the second, from 1977, to the Romanist roots of aquilian responsibility. It is in the second essay, in particular, that Villey illustrates his concept of responsibility, derived from Roman law, aimed at guaranteeing social equilibrium, rather than the prerogatives of the individual as will be the case in the modern age. All the elements of Villey's philosophy of natural law are declined in the thesis of a responsibility to be rediscovered, once the interferences of modern doctrine of natural law have been eliminated, and restored to contemporary legal experience, called upon to provide answers of justice that the individualist and formalist theory of law is unable to provide. Il saggio illustra il tema della responsabilità teorizzato da Michel Villey in due studi: il primo, pubblicato nel 1969, è dedicato alla responsabilità penale nel pensiero di San Tommaso, il secondo, del 1977, alle radici romanistiche della responsabilità aquiliana. È nel secondo saggio, in particolare, che Villey illustra il suo concetto di responsabilità, derivato dal diritto romano, finalizzato a garantire l’equilibrio sociale, più che le prerogative dell’individuo come accadrà nell’età moderna. Tutti gli elementi della filosofia del diritto naturale di Villey vengono declinati nella tesi di una responsabilità da riscoprire, una volta eliminate le interferenze del giusnaturalismo moderno, e restituire all’esperienza giuridica contemporanea, chiamata a dare risposte di giustizia che la teoria individualista e formalista del diritto non è in grado di fornire.
