The investigation starts from the reconstruction of the thought of the Roman jurisconsults about the principle of inseparability of the servile parental core. As far as the jurisprudential principle is concerned, specific attention will be paid to the thought of Ulpian, who used economic and humanitarian reasons to justify the inseparability of servile family groups mainly linked to the fund. In this regard, particular attention will be paid both to the fragments of Ulpian on the subject of the legatus of instrumentum fundi, and to those in which the Severian jurist deals with emptio venditio and redhibitio of the servus family nucleus. The doctrine of Ulpian on these issues will then be useful to understand the innovative scope of the legislative principles that emerged in the 4th century A.D. following the promulgation of the Constitution of Constantine reported in C.Th. 2.25.1 and, above all, to establish whether the said Constitution was inspired only and exclusively by the principles of the Christian religion. The case legislated by Constantine concerned, in fact, a slavish revolt that took place precisely because of the separation of the servile families following the divisions of the patrimonial and emphyteeutic funds of Sardinia.
L’indagine muove dalla ricostruzione del pensiero dei giureconsulti romani a proposito del principio di inseparabilità dei nuclei parentali servili. Per quanto riguarda il principio giurisprudenziale sarà dedicata specifica attenzione al pensiero di Ulpiano, il quale si avvale di motivazioni di carattere economico e di tipo umanitario per giustificare l’inseparabilità dei gruppi familiari servili legati principalmente al fondo. A tale proposito si riserverà particolare attenzione sia ai frammenti di Ulpiano in tema di legato di instrumentum fundi, e sia a quelli in cui il giurista severiano tratta di emptio venditio e redhibitio del nucleo familiare del servus. La dottrina di Ulpiano su queste tematiche sarà poi utile per comprendere la portata innovativa dei principi legislativi che emersero nel IV sec. d.C. a seguito della promulgazione della Costituzione di Costantino riportata in C.Th. 2.25.1 e, soprattutto, per stabilire se la suddetta Costituzione sia stata ispirata solo ed esclusivamente dai principi della religione cristiana. Il caso legiferato da Costantino scaturiva, infatti, da una rivolta servile avvenuta proprio a causa dello smembramento dei nuclei familiari servili, conseguente alle divisioni dei fondi patrimoniali-enfiteutici della Sardegna.
