The paper examines the new problems in the field of ATC liability in the face of the introduction of high degree of automation and airborne anti-collision systems. It considers also the manifacturer's for defects of appliances in this field, with specific reference to the case decided by Spanish Supreme Court for Lake Constance air disaster.
