Following a review of different fiduciary transactions, the paper deals with the principle of the freedom of form in a pactum fiduciae, promoted by the Court of Cassation, highlighting the contradictions arising between the ruling and the relevant principles of the Italian civil code.
Dopo aver ricostruito i vari tipi di operazioni fiduciarie, il saggio affronta il tema della libertà di forma, ammessa dalla Cassazione a Sezioni Unite, evidenziando le contraddizioni tra la pronuncia ed il sistema del codice civile.
