This work relates to the legal construct of the free loan concession of public goods to the Third Sector organizations. After highlighting the coexistence of conflicting logics in the legislation concerning the use of the public real estate, the legal analysis focuses on the main critical issues affecting the new discipline laid down in art. 71, paragraph 2, of Legislative Decree no. 117/2017 (Third Sector Code).
