In tema di potere ispettivo degli amministratori “non-esecutivi”

A question that, on the basis of a series of considerations, seems to be given an affirmative answer.

Una recente sentenza della Corte di cassazione stimola la riflessione sul tema dei poteri ispettivi degli amministratori “non-esecutivi”, da tempo al centro di un vivo dibattito che ruota attorno al quesito sulla possibilità per tali amministratori di ricercare autonomamente, in aggiunta a quelle ricevute, informazioni sulla gestione della società. Un quesito al quale, sulla base di una serie di considerazioni, sembra si debba dare risposta affermativa.
