This work relates to the Council of State’s recent judgment, section VI, 25 February 2019, n. 1321, on the topic of Res Judicata and the exhaustion of administrative discretion. After analyzing the main arguments of the judgement, the Author critically examines the legal solution proposed, suggesting the introduction of a duty of procedural preclusion to reach the target of a Res Judicata with a ‘stabilising entitlement’.
