Proprietà pubblica vs. proprietà privata: il caso delle reti infrastrutturali

The article is focused on the infrastructural networks and contains a comparison between private and public ownership with regard to their management, pursuant to the principles deriving both from European and Italian law. The analysis is aimed to reflect on the juridical instruments suitable for the protection of the interest concerning the access to certain goods and utilities.

Il saggio sviluppa una riflessione sul rapporto tra proprietà pubblica e proprietà privata con riferimento alle reti infrastrutturali, nel quadro della dialettica tra diritto europeo e diritto interno. La riflessione mira ad evidenziare le diverse tecniche di tutela degli interessi riferibili alla persona rispetto all'accesso a determinati beni e/o risorse.
