This paper focuses on the topic of so-called street art, particularly its challenging theoretical framework, which remains remarkably complex even today. Indeed, this phenomenon can be understood, depending on the specific cases and circumstances discussed, as a cultural and artistic manifestation or as an act of vandalism. Hence the need to outline the evolutionary lines of the street art phenomenon, as well as the main legal aspects of the topic. While awaiting specific national legislation that recognizes and legitimizes the practice of street art, the growing regulation of local governments appears of fundamental importance. These regulations, through specific regulations, allow for the recognition of this artistic and cultural phenomenon, making dedicated public spaces available to interested artists.
Il presente contributo ha come oggetto il tema della c.d. street art, con particolare riguardo al suo difficile inquadramento teorico, che risulta essere ancora oggi di notevole complessità. Infatti, tale fenomeno può essere inteso, a seconda dei casi e delle circostanze che verranno illustrate, come manifestazione culturale e artistica oppure come un atto vandalico. Da qui la necessità di tratteggiare le linee evolutive del fenomeno street art, nonché gli aspetti giuridici principali della tematica. In attesa di una disciplina nazionale specifica che riconosca e renda legittima la pratica della street art, di fondamentale importanza appare la crescente regolamentazione delle amministrazioni locali, che tramite appositi regolamenti consentono il riconoscimento di tale fenomeno artistico e culturale, mettendo a disposizione degli artisti interessati degli appositi spazi pubblici.
