The essay elaborates on the notion of death penalty in Montesquieu in order to highlight the relevant philosophical and legal problems. Most notably, the paper aims to show how according to the French author the right to deliver death does not rest solely on the admissibility of the death penalty (therefore on the possibility to include death within the right to administrate punishment). The reason is rather to be found in the social justifications about the relationship between freedom and law, since life is something that must be preserved.

Abstract

The essay elaborates on the notion of death penalty in Montesquieu in order to highlight the relevant philosophical and legal problems. Most notably, the paper aims to show how according to the French author the right to deliver death does not rest solely on the admissibility of the death penalty (therefore on the possibility to include death within the right to administrate punishment). The reason is rather to be found in the social justifications about the relationship between freedom and law, since life is something that must be preserved.
